Part I — Terms of Use

These Terms of Use ("Terms") govern your access to and use of the LUMY.tv digital signage platform, including our web dashboard, player applications, APIs, and any related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms.

1. Account & Eligibility

You must be at least 18 years old to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it updated.

2. Acceptable Use

You agree not to misuse the Services. Prohibited uses include but are not limited to: uploading or displaying unlawful, infringing, deceptive, harmful, or offensive content; violating third-party rights (including copyright, trademark, publicity, or privacy); interfering with the normal operation or security of the Services; attempting to bypass technical protections or usage limits; and using the Services to control devices in unsafe or prohibited environments.

3. Content & Licenses

You retain ownership of content you upload, schedule, or display via the Services ("Customer Content"). You grant LUMY.tv a worldwide, non-exclusive license to host, process, transmit, reproduce, and display Customer Content solely to provide and improve the Services. You represent and warrant that you have all necessary rights to Customer Content and that your use of the Services complies with applicable laws and third-party agreements (e.g., media rights for venues, advertising regulations, and local broadcasting rules).

4. Players, Devices & Network

You are responsible for procuring and maintaining compatible hardware players, displays, and network connectivity. LUMY.tv may publish recommended specifications, but performance can vary by device, media format, network conditions, and environment. You are responsible for securing devices physically and digitally, including kiosk mode, auto-start, and power management configurations.

5. Service Plans, Billing & Taxes

Some features are offered under paid plans. Fees are billed in advance on a recurring basis unless otherwise stated. You authorize us and our payment processors to charge your payment method. Fees are non- refundable except where required by law or explicitly stated. You are responsible for any applicable taxes.

6. Availability & Support

We strive to maintain high availability, but the Services may be interrupted for maintenance, updates, or reasons beyond our control. We provide support according to your plan level. Beta or experimental features may be changed or discontinued at any time.

7. Data Protection & Privacy

Our collection and use of personal data are described in our Privacy Policy. You are responsible for ensuring that your use of the Services complies with applicable data protection laws, including obtaining any necessary consents for analytics, cookies, and on-device data collection.

8. Third-Party Services

The Services may integrate with third-party services (e.g., cloud storage, analytics, authentication, or ad networks). Your use of third-party services is subject to their terms, and we are not responsible for their actions or availability.

9. Intellectual Property

LUMY.tv and its licensors retain all rights, title, and interest in the Services, including software, trademarks, and branding. Except for the rights expressly granted to you under these Terms, no other rights are granted by implication or otherwise.

10. Termination

We may suspend or terminate your access to the Services if you breach these Terms, cause harm or risk, or fail to pay fees. You may stop using the Services at any time. Upon termination, your license to the Services ends, but sections that by their nature should survive will continue to apply.

11. Disclaimers & Limitation of Liability

The Services are provided "as is" without warranties of any kind. To the fullest extent permitted by law, LUMY.tv disclaims all warranties and will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, business, or goodwill.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by posting an updated version and updating the date above. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

Part II — Terms of Service

The following terms supplement the Terms of Use above.

Acceptance of Terms

By accessing and using LUMY's digital signage platform, you accept and agree to be bound by these terms.

Use License

Permission is granted to use LUMY's platform for personal or commercial digital signage purposes. This is a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials contrary to applicable licenses
  • Use the materials without proper licensing where required
  • Attempt to reverse engineer any software contained on the platform
  • Remove any copyright or other proprietary notices from the materials

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding your password and for all activities that occur under your account.

Account Responsibilities

  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use
  • Accept responsibility for all activities under your account
  • Provide accurate and up-to-date information

Content Guidelines

You are responsible for all content you upload, display, or transmit through our platform. You agree not to use our service to:

  • Display illegal, harmful, or offensive content
  • Infringe on intellectual property rights
  • Transmit malicious software or code
  • Violate any applicable laws or regulations

Service Availability

We strive to maintain high availability but cannot guarantee uninterrupted service. We may modify, suspend, or discontinue any part of our service with or without notice.

Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as specifically stated in our refund policy.

Limitation of Liability

In no event shall LUMY or its suppliers be liable for any indirect or consequential damages, including loss of data or profit, arising out of the use or inability to use the platform.

Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason including breach of the Terms.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through our platform.
